Terms, Payment & Refund Policy

These terms govern every MONARQX build engagement. In plain English: you pay a deposit to start, we build, you pay the balance on delivery, and you own what we hand you outright. The detail is below. A privacy policy follows the terms.

Acceptance by payment. These terms are linked from every MONARQX checkout and from our website. By paying a deposit, subscribing to a MONARQX plan, or paying any MONARQX invoice, you confirm that you have read and accept these terms. If you do not accept them, do not pay — email dylan@monarqx.com with any questions first.

1Who we are

MONARQX is operated by Dylan Alaalatoa, trading as a sole trader (ABN 32 138 922 129), Australia. Contact: dylan@monarqx.com. In these terms, "we"/"us"/"MONARQX" means the operator, and "you"/"client" means the person or business purchasing a build.

2What you're buying

MONARQX designs and builds a business or business system for you — spanning brand, a built and hosted site, core systems, and, on larger packages, integrations and automation, delivered per the package you select (Build & Go — Lean or Build & Go — Full). On the Managed by MONARQX plan, MONARQX also operates the digital side of your business on an ongoing basis while your subscription is active. The free idea test on our site is a non-binding preview and creates no obligation on either side.

The exact deliverables, timeline, and any assumptions for your engagement are confirmed in writing (email or a written scope summary) before the deposit is taken. That written scope, together with these terms, forms our agreement.

3Payment & deposits

All prices are in Australian dollars (AUD). Any GST that applies will be shown separately on your tax invoice. Payment is taken through Stripe. Work begins only once the deposit has cleared — we don't schedule your build or kickoff before that.

Payment schedule

Build deposits are paid via the checkout link on our site. Each subsequent amount is invoiced through Stripe and is due within 7 days of the invoice date. Final deliverables and access are released once the final payment is received.

Late payment. Overdue balances accrue a late fee of 1.5% per month (or part month) on the outstanding amount. We may pause work while an invoice is overdue.

4Refunds & cancellation

The deposit reflects the time, planning, and third-party costs we commit to as soon as your build begins. It is a genuine pre-estimate of that commitment, not a penalty.

Cancelling the Managed subscription

You may cancel the Managed by MONARQX subscription at any time via your billing portal or by written notice; cancellation takes effect at the end of your current billing period, and no further payments are taken. Fees already paid for the current period are not refunded (this doesn't limit any rights under the Australian Consumer Law). On cancellation you keep your entire business — brand, site, code, content, customer relationships, and 100% of its revenue — and we hand you an Exit Pack: a full snapshot of the business plus a plain-English runbook for running it yourself. Your domain, hosting, and third-party accounts are registered in your name from day one, so nothing needs to be reclaimed from us. What ends is access to the MONARQX engine — the automated running, management, and improvement — and your licence to it, per the Customer Agreement. If you re-subscribe within 90 days, your service resumes at the rate you left on.

If you're ever unhappy with the direction, tell us early. You review the plan before we build and give notes along the way, so problems get fixed in-flight rather than at the end.

5Scope & revisions

Your written scope defines what's included. Anything not expressly listed in it is out of scope and, if you want it, is quoted separately in writing before we proceed.

6Ownership

On final payment, everything we build for you is yours — the brand, the site, the systems, the files, and the code, with no lock-in, no equity, and no share of your revenue. Until the final payment is received, ownership of the deliverables remains with MONARQX. On the Managed plan, your business is yours throughout the subscription — the subscription pays for the running of it, never for the owning of it. The only thing that stays ours, on every plan, is the underlying MONARQX engine and internal tooling used to produce and operate the work — you own everything it makes, not the machine itself.

7Human safeguard

Anything that touches money, contracts, or the real world goes through a person. MONARQX never moves your money, makes payments, or signs anything on its own. This is a safeguard for you, and it means some steps require your explicit action.

8Warranty & liability

We deliver the agreed scope with reasonable care and skill. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded. To the extent permitted by law, MONARQX is not liable for indirect or consequential loss, and our total liability for any claim is limited to the fees you have paid us for the affected engagement. A built business carries real running costs (domains, tools, subscriptions), which we itemise for you up front; those ongoing costs are yours once the build is handed over.

9Governing law

These terms are governed by the laws of Australia, and both parties submit to the jurisdiction of the Australian courts. If any part of these terms is unenforceable, the rest continues to apply.

Privacy policy

We collect only what we need to deliver your build and take payment: your name, business name, contact details, billing address, and any tax ID you provide at checkout, plus the details of your idea and scope. Card payments are processed by Stripe — we never see or store your full card number.
